Welcome to NolaJade. “We,” “us,” and “our” refer to NolaJade. We operate this website and online store, including all content, products, and services (the “Services”). NolaJade is powered by Shopify, which enables us to provide the Services to you.

Skincare results vary. Our product descriptions are not medical advice. Consult a healthcare professional before use if you have a medical condition, allergy, or sensitivity.

3. Orders

When you place an order, you make an offer to purchase. We may accept or decline any order for any reason. An order is not accepted until we confirm it and process your payment. Review your order carefully before submitting; we may not be able to cancel an order after it is accepted.

You agree that purchases are for personal or household use only, not for resale or export unless we authorize it in writing.

4. Pricing and payment

Prices, discounts, and promotions may change without notice. The price charged is the price in effect when you place your order, as shown in your order confirmation. Unless stated otherwise, prices do not include taxes, shipping, or import duties.

You agree to provide valid payment information and authorize us to charge your payment method for your order, including applicable taxes and shipping.

We may correct pricing or other errors at any time, including after you submit an order. If we cancel or change an order due to an error, we will try to notify you using the contact information you provided.

5. Shipping and delivery

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other events outside our control. Risk of loss passes to you when we transfer your order to the carrier.

6. Intellectual property

All content on the Services, including text, images, logos, product names, and design, is owned by NolaJade or our licensors and is protected by intellectual property laws. You may use the Services for personal, non-commercial use only. You may not copy, reproduce, distribute, modify, or exploit any part of the Services without our prior written permission.

8. Relationship with Shopify

NolaJade is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with NolaJade. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and NolaJade, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with NolaJade.

10. Reviews and user content

TO THE FULLEST EXTENT PERMITTED BY LAW, NOLAJADE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO NOLAJADE FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow limitations on incidental or consequential damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless NolaJade, Shopify, and our affiliates, officers, directors, employees, and agents from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, your breach of these Terms, or your violation of any law or third-party rights.

15. Governing law

These Terms are governed by the laws of the state where NolaJade is headquartered, without regard to conflict-of-law rules. You and NolaJade consent to the exclusive jurisdiction of the courts in that state for disputes arising from these Terms or the Services.

16. Changes

We may update these Terms at any time by posting the revised version on this page. The updated Terms take effect when posted unless stated otherwise. Your continued use of the Services after changes are posted means you accept the updated Terms.

17. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy and Return & Refund Policy, are the entire agreement between you and NolaJade regarding the Services. We may assign these Terms; you may not assign them without our consent.
